Environmental groups filed a lawsuit against Suncor Energy on Tuesday, claiming that pollution from its Commerce City refinery in Colorado has caused long-term damage to nearby communities.
The lawsuit, brought by Earthjustice on behalf of GreenLatinos, the Sierra Club, and 350 Colorado, was filed in federal court in Denver.
The groups allege that Suncor has violated the Clean Air Act over 9,000 times in the past five years, exceeding federal limits for particulate matter and toxic emissions such as benzene and formaldehyde.

“Suncor has repeatedly exceeded its air permit limits for years and is sending that pollution into the surrounding neighborhoods,” said Ian Coghill, a senior attorney with Earthjustice.
Calgary-based Suncor stated it is aware of the lawsuit and is currently reviewing it. The Commerce City refinery, Colorado’s sole oil refinery, processes about 98,000 barrels of oil daily.

It has faced several issues recently, including a fire in December 2022 and ongoing air quality complaints from local residents. In February, Colorado fined Suncor $10.5 million for air pollution violations between 2019 and 2021.
