European renewable ethanol producers have initiated legal action against the EU’s RefuelEU Aviation Regulation, arguing that it unfairly excludes crop-based biofuels from efforts to mitigate greenhouse gas emissions in air transport.Â
This marks the industry’s second legal challenge in recent months, following a similar case against the FuelEU Maritime Regulation in December 2023.
Representing a significant portion of the EU’s renewable ethanol production, companies behind the challenge aim to annul specific sections of the RefuelEU Aviation Regulation.
They contend that excluding crop-based biofuels contradicts their proven emissions reduction and sustainability credentials established under the Renewable Energy Directive. David Carpintero, Director General of ePURE, emphasized the importance of empowering renewable ethanol in the Union’s interest rather than excluding it.
The legal challenge asserts several arguments, including claims that the European Parliament and Council erred in their assessment by disregarding available scientific and technical data. Additionally, it alleges a violation of the principle of proportionality by effectively imposing bans on using RED-compliant crop-based biofuels.
The challenge, filed by ePURE and Pannonia Bio Zrt. members, was submitted to the General Court of the European Union on January 24th.
